USCIS published a final version of the 'Public Charge' rule, officially titled "Inadmissibility on Public Charge Grounds." Depending on the type of application filed, the new Form I-944 would be required.
Who Must File Form I-944?
All individuals applying for adjustment of status using Form I-485 are required to submit Form I-944, unless they are in a class that is exempt by statute or regulation. If you are a family filing for permanent residence, each application must be accompanied by a separate Form I-944.
It may also be requested by USCIS when filing for visa extension or change of status. This applies to H-1B, L1, H4, L2, F1 students, and OPT holders.
Exemptions
Categories exempt from the public charge ground include:
- VAWA self-petitioners
- Special Immigrant Juveniles
- Asylees and Refugees
- Victims of human trafficking
- U.S. Armed Forces Service Members
What Information Is Required?
The 18-page form requires many details including:
- Age and family information
- Health information and health insurance
- Assets and financial status
- Mortgages, loans, and credit score
- Education and occupational skills
- English and other language skills
How USCIS Assesses Your Application
USCIS will consider all details as either negative or positive factors to determine if an applicant would become a public charge in the future. For example:
- Being 32 years old is a positive factor with neutral weightage
- Having a health condition requiring treatment is a negative factor
- Not having health insurance is a strong negative factor
Warning About Falsification
If you knowingly and willfully falsify or conceal a material fact or submit a false document with your Form I-944, USCIS will deny your form and may deny any other immigration benefit. You will face severe penalties and may be subject to criminal prosecution.
